By accessing or using the website www.samaconsulting.in (the "Site") or any services provided by SAMA Consulting ("SAMA", "we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Site or services.

These Terms apply to all visitors, candidates, employers, and other users of the Site. We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms.

SAMA Consulting is a healthcare-focused recruitment consultancy headquartered in Chennai, Tamil Nadu, India. We provide the following services:

• Permanent and contract staffing for healthcare organisations • Nurse and allied health professional recruitment • Executive search for senior healthcare leadership roles • Recruitment Process Outsourcing (RPO) for hospitals and clinics • Job listing and career services for healthcare candidates

Our services are intended for healthcare employers seeking to hire qualified professionals, and for healthcare candidates seeking employment opportunities within India.

You must be at least 18 years of age to use this Site. By using the Site, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms.

Employers using SAMA's services must be registered business entities in India or authorized to conduct business in India in accordance with applicable laws.

Employers engaging SAMA Consulting for staffing services agree to:

• Provide accurate, complete, and lawful job descriptions and requirements • Comply with all applicable Indian labour laws, including the Employment Exchange (Compulsory Notification of Vacancies) Act, 1959, the Contract Labour (Regulation and Abolition) Act, 1970, and any other applicable regulations • Maintain equal opportunity practices and not discriminate on the basis of caste, religion, gender, disability, or other protected characteristics under Indian law • Treat all candidate information shared by SAMA as confidential and use it solely for recruitment purposes • Pay all agreed service fees as per the terms of any separate service agreement signed with SAMA Consulting

SAMA Consulting acts as an intermediary. We are not the employer of any candidate placed through our services unless explicitly stated otherwise in a separate written agreement.

Candidates registering with or submitting information to SAMA Consulting agree to:

• Provide accurate, truthful, and complete information in all applications, CVs, and profiles • Disclose any relevant qualifications, certifications, and registrations (e.g., Tamil Nadu Medical Council, Indian Nursing Council) honestly • Notify SAMA promptly of any changes to their availability, employment status, or contact details • Not submit fraudulent or misleading information — doing so may result in immediate disqualification and may be reported to relevant authorities • Understand that SAMA does not guarantee placement or employment

SAMA Consulting will not charge any fee to candidates for its job placement services. Any third party claiming to charge fees on behalf of SAMA Consulting should be reported to us immediately.

All content on this Site, including but not limited to text, graphics, logos, icons, images, audio clips, and software, is the property of SAMA Consulting or its content suppliers and is protected under applicable Indian and international intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or in any way exploit any of the content on this Site without our prior written consent.

You agree not to use the Site or our services to:

• Post or transmit any false, misleading, defamatory, or fraudulent content • Collect or harvest any personal information from other users without their consent • Interfere with or disrupt the integrity or performance of the Site • Attempt to gain unauthorized access to any portion of the Site • Use automated tools (bots, scrapers) to extract data from the Site • Violate any applicable local, national, or international law or regulation • Engage in any conduct that could harm the reputation of SAMA Consulting

The Site and all services are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

SAMA Consulting does not warrant that the Site will be uninterrupted or error-free, that defects will be corrected, or that the Site is free of viruses or other harmful components.

To the fullest extent permitted by applicable law, SAMA Consulting, its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Site or services.

SAMA Consulting's total liability to you for any claim arising from use of the Site shall not exceed INR 10,000 (Ten Thousand Rupees) or the amount paid by you to SAMA in the preceding three months, whichever is lower.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Chennai, Tamil Nadu, India.

Before initiating any legal proceedings, both parties agree to attempt to resolve any dispute amicably through good-faith negotiation for a period of at least 30 days.
